The Global ABS Legal Clinics
An activity developed in the framework of implementation of the UNDP-GEF Global ABS Project
The objective of the service provided under the Global ABS legal clinics is to support the provider side of the negotiation of ABS agreements to balance the negotiation and ensure the rights of providers into the terms of the agreement. This service aims to cover some of the demands from indigenous peoples and local communities expressed during the negotiation of the Nagoya Protocol to create an ombudsman on ABS that will support, and address issues and complaints related to indigenous peoples and local communities. This service will provide support to providers, in particular indigenous peoples and local communities, in the negotiation and enforcement of ABS contracts.
Also, strengthening legal frameworks and institutional capacities on ABS is at the cornerstone of the UNDP-GEF Global ABS Project with the development or update of the legal frameworks of the 23 countries involved in the project. However, the project also acknowledges that for most of the countries, the 3-year period of the project may be a short time to develop a full ABS legal system that gets the political support and it is able to go through the different legal procedures to be approved during the project, and, therefore there is always the possibility of the need of legal support at different stages to address pending issues that require specific legal support.
In this context, the Global ABS Community, in the framework of the UNDP-GEF Global ABS Project, promotes the establishment of the first Global ABS Legal Clinics. The Global ABS Legal Clinic will serve as a liaison between ABS-specialized legal firms and ABS stakeholders, providing strategic support on the following topics:
- National ABS legal frameworks and regulations;
- Legal counseling and support in the drafting of ABS contracts; and
- Legal counseling on preventing biopiracy at the national and global level.
The Global ABS Legal Clinics will therefore serve as an intermediary, connecting ABS stakeholders and experienced ABS legal firms, ensuring that all actors in the ABS value chain play based on equal opportunities, supporting the goal of the project of generating trust between providers and users of genetic resources and associated traditional knowledge.
ABS Legal Helpdesk Request
To apply and get support from the Global ABS Legal Clinics´ helpdesk, follow the steps below:
- Fill in the ABS legal request ticket. Please include your name, address, organization you represent, telephone number and two email addresses. On the comment section, please describe, as detailed as possible, your request.
- You should receive a notification email. Please keep in hand the legal request ticket number assigned to your case.
- From this point, a legal ABS expert will contact you to provide support.
All the information received under this service is treated as confidential information and it will not be shared with third parties without the consent of the party that has submitted the request.
